How much does it cost?

To make documents for divorce, we charge lenient rates. It is just $159. This applies to both joint application and single application.

 

What all includes in Fees?

Our fees includes your completed application form, checklist and the instructions of step by step lodging the application in the court.

 

Are there any other hidden charges?

No, there is no such hidden or extra charge besides $159. But, you need to bear the court fees of $849. If you are eligible for an exemption or reduction of this fee, you need not pay this. Holding concession card can bring about savings on court fees.

 

Separation time requirement for divorce?

When it comes to separation time requirement, it is 1 year or 12 months time. During this time, the couple under one roof separation will also be considered.

 

What if I was born overseas?

If both you and your spouse are the citizens of Australia and have lived in Australia for more than 1 year, you may apply for divorce here. What you need to do is providing copy of Australian citizenship.

 

Where do I file my application?

After we have sent you the details along with needed documents to your email address, you may visit your nearest court and submit the same. In your email, we will send detailed step by step instructions on how to proceed. We will also provide you the names of the courts nearest to your location.

 

How long will it take you to prepare my application?

Yes you can. However it is recommended to have a professional either prepare, or look over the documents before filing and paying the court fee of $865. This is due to the fact some legal terminology may be misunderstood or misinterpreted.

Does the cost of using onlinedivorceservice.com.au cover court filing fees?
No. Court filing fees, $865 are in addition to the cost of using our service. If you are on low income you may be eligible for a reduction of exemption of the filing fee if you hold certain means tested concession cards. Note that if you are joint applicants you will both require concession cards to obtain the reduced court fee. The reduced fee is $290.

 

When can I file for a divorce?
Irreconcilable differences is the only ground for legally dissolving a marriage or civil union. This means that your relationship has broken down and is at an end. Neither of you is blamed for this. The only way of proving that your relationship has broken down irreconcilably is by being separated for 12 months. Only then can the court dissolve your marriage or civil union. You cannot shorten the 12 months period, even if you both agree to the dissolution.
